Si pensar es un modo de comportamiento del Dasein y si no es dejado a la arbitrariedad, sino que está sometido a leyes, entonces cabe preguntar: ¿cuáles son las leyes fundamentales que pertenecen al pensar como tal? ¿Cuál es el carácter de esta legalidad y regulación? Sólo obtenemos la respuesta mediante una interpretación concreta de las leyes fundamentales del pensar que pertenecen a su esencia en general.

¿Qué quiere decir “principios” (proposiciones fundamentales) y cuál es su esencia? ¿Cuáles hay? Tradicionalmente son: el principium identitatis, el principium contradictionis, el principium exclusi terti, el principium rationis sufficientis. ¿Éstos son todos? ¿En qué orden? ¿En qué relación intrínseca se encuentran? ¿Dónde tienen su fundamento y su necesidad? ¿Se trata de leyes naturales, leyes psicológicas o leyes morales? O ¿de qué tipo son para que el Dasein se le someta?

Con todo, la caracterización de esta legalidad del pensar nos conduce a la cuestión de las condiciones de su posibilidad: ¿Cómo debe el ente que está sometido a tales leyes, el Dasein mismo, estar constituido para poder estar sometido a semejante legalidad? ¿Cómo ‘es’ el Dasein, según su esencia, para que pueda surgir en él y para él una constricción como la legalidad lógica?

Estos principios o proposiciones fundamentales no son reglas que están junto al pensar, que quedaría determinado desde otra parte, sino que son los fundamentos para las proposiciones en general, fundamentos que hacen posible el pensar, y esto de nuevo sólo porque son fundamentos del comprender, de la existencia, de la comprensión del ser, del Dasein, de la trascendencia originaria.

Es claro que, con estos problemas, estamos ya en el círculo de la pregunta por la constitución del ser del (25) Dasein. Aún más: la constricción y la legalidad presuponen en sí mismas la libertad como fundamento de su propia posibilidad. Sólo lo que existe como una esencia libre puede estar dotado de una legalidad que le constriña. Sólo la legalidad puede ser origen de la vinculación. Un problema fundamental de la lógica, la legalidad del pensar, se descubre, en su fundamento, como un problema de la existencia humana, como un problema de la libertad.

If thinking is a mode of Dasein’s comportment and if it is Not abandoned to arbitrariness but stands under laws, then the question must be asked: What are the fundamental laws belonging to thinking as such? What is, in general, the character of this lawfulness and regulation? We can obtain an answer only by way of a concrete interpretation of the basic laws of thinking which belong to its essence in general.

What is meant by “basic principles,” and what is their essence? What principles are there? The tradition gives us the principle of identity, the principle of non-contradiction, the principle of the excluded middle, the principle of sufficient reason, principium identitatis, principium contradictionis, principium exclusi tertii, principium rationis sufficientis. Are these all? In what order do they Stand? What intrinsic connection do they have? Where do they find their foundation and their necessity? Are we dealing here with laws of nature, with psychological or moral laws? Or of what sort are they that Dasein is subject to them?

But the account of the laws governing thinking pushes us back into the question of the conditions of their possibility. How must that being which is subject to such laws, Dasein itself, be constituted so as to be able to be thus governed by laws? How “is” Dasein according to its essence so that such an obligation as that of being governed by logical laws can arise in and for Dasein?

These basic principles (Grund-Sätze) are not rules alongside a thinking that would be determined from elsewhere, but they are the grounds (Gründe) for statements (Sätze) in general, grounds which make thinking possible. And they are this, furthermore, only because they are the bases (Gründe) for understanding, existence, the understanding of being, Dasein, and primal transcendence.

It is becoming clear that with such problems we are already immediately in the realm of the question concerning the constitution of Dasein’s being. Even more, obligation and being governed by law, in themselves, presuppose freedom as the basis for their own possibility. Only what exists as a free being could be at all (20) (25-26) bound by an obligatory lawfulness. Freedom alone can be the source of obligation. A basic Problem of logic, the law-governedness of thinking, reveals itself to be a problem of human existence in its ground, the problem of freedom.

Wenn das denken eine Verhaltungsweise des Daseins ist und wenn es keiner Willkürlichkeit anheimgegeben ist, sondern Gesetzen untersteht, dann wird zu fragen Sein: Welches sind die Grundgesetze, die zum Denken als solchem gehören, welches ist überhaupt der Charakter dieser Gesetzlichkeit und Regelung? Die Antwort gewinnen Wir nur auf dem Wege einer konkreten Interpretation der Grundgesetze des Denkens, die zu seinem Wesen überhaupt gehören.

Was heißt: »Grund-Sätze«, und was ist das Wesen derselben? Welche gibt es? Überliefert sind: das principium identitatis, das principium contradictionis, das principium exclusi tertii, das principium rationis sufficientis. Sind dies alle? In welcher Ordnung, in welchem Inneren Zusammenhang stehen sie? worin Haben sie ihr Fundament und ihre Notwendigkeit? Handelt es sich um Naturgesetze, um psychologische oder moralische Gesetze? Oder welcher Art sind sie, daß das Dasein ihnen untersteht?

Die Charakteristik dieser Gesetzlichkeit des Denkens aber treibt zurück in die Frage nach den Bedingungen ihrer Möglichkeit: Wie muß dasjenige Seiende, das solchen Gesetzen untersteht, das Dasein Selbst, verfaßt sein, um in solcher Gesetzlichkeit stehen zu können? Wie »ist« das Dasein seinem Wesen nach, daß in ihm und für es eine solche Verbindlichkeit wie die logische Gesetzlichkeit entspringen kann?

Diese Grund-Sätze sind Nicht Regeln neben dem Denken, das anderswoher bestimmt würde, sondern sie sind Gründe für Sätze überhaupt, Gründe, die Denken ermöglichen; und das wiederum nur, weil sie Gründe sind für Verstehen, Existenz, Seinsverständnis, Dasein, Urtranszendenz.

Es wird deutlich: mit solchen Problemen stehen wir schon unmittelbar im Bezirk der Frage nach der Seinsverfassung des (25) Daseins. Mehr noch: die Verbindlichkeit und Gesetzlichkeit setzt in sich selbst als Grund ihrer eigenen Ermöglichung die Freiheit voraus. Nur was als freies Wesen existiert, kann überhaupt einer Gesetzlichkeit als verbindlicher verhaftet sein. Nur Freiheit kann Ursprung von Bindung sein. Ein Grundproblem der Logik, die Gesetzlichkeit des Denkens3 enthüllt sich als ein Problem menschlicher Existenz in ihrem Grunde, als Problem der Freiheit.
